Terms and Conditions

1. Service Provider Information

Photography services are provided by KASON Jacek Jarczok, operating under the brand name HeyBuddy.photo.

2. Definitions

• Service Provider — KASON Jacek Jarczok / HeyBuddy.photo.
• Client — an individual or entity entering into an agreement for a photography session.
• Session — a dog and pet photography service provided by the Service Provider.
• Reservation Fee — an amount paid when booking a session date, credited towards the total session price.
• Final Files — selected and professionally edited photographs delivered to the Client in full resolution.

3. Booking and Reservation Fee

A session date is considered booked after:

1. Submitting an inquiry via the contact form or direct message on social media.
2. Agreeing on the session details (package, date, and location).
3. Paying the reservation fee specified in the booking confirmation.

The reservation fee covers reserving the date and preparing for the session and is non-refundable in the cases specified in these Terms & Conditions.

Payment of the reservation fee constitutes acceptance of these Terms and Conditions.

4. Session Delivery

Session duration depends on the selected package:

• Hey — up to 60 minutes, one dog.
• Buddy — approximately 90–150 minutes, multiple dogs may participate.
• Adventure — duration and scope agreed individually.

The Service Provider will make every reasonable effort to conduct the session as agreed. Due to the natural and animal-focused nature of the session, the Service Provider cannot guarantee a specific number of “perfect” photographs but will provide a professional, patient, and dedicated experience throughout.

The Client is responsible for their dog's behaviour during the session and agrees to maintain control of the dog at all times. The Service Provider is not liable for any damage caused by the animal to third parties, other animals, or property.

In the event of severe weather conditions (such as thunderstorms or heavy rain) or if the dog is clearly unwell, both parties may agree to reschedule the session at no additional cost.

5. Image Delivery

After the session, the Client will receive access to a proofing gallery and may select images according to the chosen package:

• Hey: 5 images selected from all successful photographs.
• Buddy: 10 images selected from all successful photographs.
• Adventure: the number of images is agreed individually.

The total number of photographs available for selection depends on the outcome of the session and is not guaranteed.

Additional images beyond the package limit may be purchased for 80 PLN per image and will receive the same level of professional editing as included images.

Fully edited, high-resolution images will be delivered within 14 business days after the Client has selected their images and settled any remaining balance. Final files will be provided via a secure download link.

In exceptional circumstances, the delivery timeframe may be extended. The Client will be informed in advance and a new delivery date will be agreed individually.

The Client is responsible for downloading the files within 30 days of receiving the download link. After this period, the link may be deactivated, and the Service Provider does not guarantee continued storage of the original files.

6. Copyright and Licence

Copyright and all intellectual property rights to the photographs remain the property of the Service Provider (Jacek Jarczok) as the creator, in accordance with applicable copyright laws.

Upon full payment and delivery of the final images, the Client receives a non-exclusive license to use the photographs for:

• personal use (prints, gifts, keepsakes);
• sharing on social media platforms (Instagram, Facebook, and others) without altering the images and, where possible, with credit to the photographer;
• other non-commercial personal purposes.

The resale of photographs, transfer to third parties for commercial use, or modification of the images without written permission from the Service Provider is prohibited.

Photographs featuring animals only may be used by the Service Provider in portfolios, websites, social media, and promotional materials. The Client may withdraw consent for such use no later than the date of the session.

7. Cancellation and Rescheduling

Cancellation by the Client

• Cancellation at least 7 days before the session: the reservation fee is non-refundable, but the Client may reschedule the session once within 6 months of the original session date.
• Cancellation less than 7 days before the session: the reservation fee is non-refundable and cannot be transferred.
• Failure to attend the session without prior notice: the reservation fee is forfeited.

Cancellation by the Service Provider

In the event of illness, emergency, or other circumstances preventing the session from taking place, the Service Provider will offer an alternative date. If the Client does not accept any proposed dates, all payments made will be refunded in full.

8. Complaints

Complaints must be submitted by email to hello@heybuddy.photo within 14 days of receiving the final images and should include a description of the issue.

The Service Provider will review the complaint within 14 business days and provide a response by email. If a complaint is upheld, the resolution may include additional editing, an extra image, or, where justified, a partial refund.

Complaints relating to artistic style, editing preferences, or image composition are not grounds for complaint if they are consistent with the portfolio presented before the agreement was concluded.

9. Final Provisions

Any matters not covered by these Terms & Conditions shall be governed by the laws of Poland, including the Civil Code and applicable copyright legislation.

The parties agree to attempt to resolve any disputes amicably. If no agreement can be reached, disputes shall be settled by the competent court in accordance with applicable law.

The Service Provider reserves the right to amend these Terms & Conditions. Clients will be notified of any changes at least 14 days in advance. Bookings made before the changes take effect will be governed by the version of the Terms & Conditions applicable at the time of booking.
